The Cancer Cure Coalition Protests the Federal Courts Ruling against the Abigail AllianceWe at the Cancer Cure Coalition were dismayed by the decision of the Court of Appeals for the District of Columbia denying the right of critically ill patients to access treatments that are in clinical trials. These treatments have already shown evidence of safety and effectiveness, yet the court is preventing access to them by patients who are likely to die without them. We believe that this decision violates the Fifth Amendment of the U.S. Constitution stating that people cannot be deprived of life without due process of law. We believe that the FDA, in opposing the right of people with terminal illnesses to potentially life saving treatments is violating the very principles on which the United States of America was founded. The Declaration of Independence states “We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights that among these are Life, Liberty and the pursuit of Happiness”. These rights are fundamental to all mankind and we deplore the court of Appeals support of this denial. Not only are the FDA’s policies delaying new products from reaching patients but these policies have caused huge increases in medical costs. The required clinical trials cost an average of over eight hundred million dollars and can take up to ten years before a new drug is approved. Many promising new treatments are abandoned only because of the high cost of the trials. We also believe that the FDA in only considering the evidence from their trials and not all the information available is in violation of the instructions given by the Congress in its mandating act. There are many treatments that have been tested, approved and are widely used in other countries and that evidence is being ignored by the FDA. Gene therapy, such as Advexin, and cancer vaccines such as Provenge and GVAX are examples of important new treatments for cancer that have shown safety and effectiveness to which access is being denied. While the FDA delays approval, patients are suffering and dying. The Cancer Cure Coalition will be supporting the Abigail Alliance in its appeal of this decision to the Supreme Court of the United States.
